札幌高裁、サケ捕獲の「先住権」めぐる控訴を棄却

北海道ほっかいどう浦幌町うらほろちょうのアイヌ民族団体みんぞくだんたい「ラポロアイヌネイション」が、地元じもと河川かせんでのサケ捕獲ほかくは先住権せんじゅうけんに基もとづくとして、現行法げんこうほうで禁止きんしされないことの確認かくにんを国くにと北海道ほっかいどうに求もとめた訴訟そしょうの控訴審判決こうそしんはんけつで、札幌高裁さっぽろこうさいは七月二日しちがつふつか、原告側げんこくがわの請求せいきゅうを退しりぞけた一審いっしん・札幌地裁判決さっぽろちさいはんけつを支持しじし、原告側げんこくがわの控訴こうそを棄却ききゃくした。

In an appeal ruling on a lawsuit in which the Ainu ethnic group 'Raporo Ainu Nation' of Urahoro Town, Hokkaido, sought confirmation from the state and the Hokkaido prefecture that catching salmon in local rivers is based on indigenous rights and is not prohibited under current laws, the Sapporo High Court on July 2 upheld the first-instance Sapporo District Court ruling that rejected the plaintiffs' claim, and dismissed the plaintiffs' appeal.

アイヌ民族みんぞくの先住権せんじゅうけんをめぐる裁判さいばんは国内こくないで初はじめての事例じれいであり、その判決はんけつが注目ちゅうもくされていた。原告側げんこくがわは、先住民せんじゅうみんとして固有こゆうの権利けんりである「先住権せんじゅうけん」に基もとづき、水産資源保護法すいさんしげんほごほうなどの現行法げんこうほうによる制限せいげんを受うけることなく、伝統的でんとうてきなサケの捕獲ほかくを行おこなう権利けんりがあると主張しゅちょうしていた。

This lawsuit over the indigenous rights of the Ainu people is the first such case in Japan, and its ruling has attracted close attention. The plaintiffs argued that, based on their 'indigenous rights' which are inherent rights as indigenous people, they have the right to engage in traditional salmon fishing without being subject to restrictions under current laws such as the Fisheries Resource Protection Act.

しかし、一審いっしんの札幌地裁さっぽろちさいは、アイヌ民族みんぞくが固有こゆうの文化ぶんかを享有きょうゆうする権利けんりを有ゆうすることを認みとめつつも、河川かせんは公共こうきょうの財産ざいさんであり、特定とくていの集団しゅうだんが排他的はいたてきに漁業ぎょぎょうを行おこなう権利けんりは認みとめられないとして、原告側げんこくがわの請求せいきゅうを退しりぞけた。二審にしんの札幌高裁さっぽろこうさいもこの判断はんだんを踏襲とうしゅうし、現行法げんこうほうの規制きせいの範囲外はんいがいで先住権せんじゅうけんとしての漁業権ぎょぎょうけんを認みとめることは困難こんなんであると結論付けつろんづけた。

However, while recognizing that the Ainu people have the right to enjoy their unique culture, the first-instance Sapporo District Court rejected the plaintiffs' claim, stating that rivers are public property and that specific groups cannot be granted exclusive fishing rights. The Sapporo High Court, in the second instance, also followed this reasoning and concluded that it is difficult to recognize fishing rights as an indigenous right outside the scope of current legal regulations.
